Here is the deal.. I bought this place for $480k before the building was finished and by the time I moved in, it was worth $50k (they were selling for $520k) above what I paid. I’m the original owner of the loft but got married and am about to have a kid so I’m trying to move into a house in Orange County. I’m about to put this condo on the market for $490k next week through an agency but thought I’d try to sell it through a private party first before I do that. If I do the sale through an agency I’d be paying about 6% commission and the closing costs would be around $10k. This is approximately $38k for just selling the house if I go that route. If you are interested in this property, we can both save money by doing this privately. I can use an escrow company that will do closing costs for around $2500-$3000 and we wouldn’t need to pay out sales commission.
The listing agent has agreed to help me show the place if I give him a fee to do it but I promised I would use him to list the property if I can’t sell it on my own. You may not tell the listing agent, (or any other human being, including your broker
and your assistant) that this contact concerns the Homeowner’s mortgage, or that
the Homeowner is late on their payment. If the listing agent asks if this is about the
Homeowners mortgage, you should say, “My agreement with Titanium is that I can’t
disclose the reason for the report I do, and I am not here to collect money, or serve
papers, this is probably good news for the Homeowner.
What if the Homeowner tells you that he has already talked to the Servicer,
and the Servicer didn’t want to work with them?
You will hear this quite often. The reason is because when the Homeowner first fell
behind on their payments, the Collection Department called to collect the late
payment. Since the Collection Department is not always authorized to offer the
Homeowner work out solutions, or even suggestions, the Homeowner may be left
with the idea that if the loan is not “paid in full, the home will be foreclosed.”
Let the Homeowner know that whomever they spoke to in the past may not have
worked with them; however, the Servicer may want to work with them now. If the
Servicer did not want to work with them, you would not be there and the Servicer
would just foreclose. The Servicer doesn’t send out a HRC to foreclose, the only
reason you are there is because the Servicer is seeking a solution other than
foreclosure.
What if the Homeowner has already made arrangements with the Servicer
to bring their mortgage current?
If the Homeowner represents that they have already made arrangements with their
Servicer, the HRC should first attempt to make a Warm Transfer to the Servicer, if
the Homeowner is willing, to verify that the Servicer is helping them. Make a note on
the file and leave a Titanium Solutions business card with the Homeowner. The HRC
should also input the info on the Homeowner Contact Form on the Titanium
Solutions website. The HRC must still complete the Property Inspection/Opinion of
Value and upload a photo of the property to the Titanium Solutions website
Dos and Don’ts
1. Do remember to complete your assignments on or before the due date on the
assignment, or you will not be paid for the assignment.
2. Do try to always develop relationships of trust and concern with the
Homeowner(s).
3. Do become aware of predatory lending practices in your community.
4. Do leave your Titanium Solutions business card with the Homeowner(s).
5. Do complete the assignment before talking to the Homeowner about listing
the property for sale. That means, you should talk to the Homeowner about
